Negotiation is the most informal dispute resolution process, where parties communicate directly with each other to reach a mutually acceptable agreement. AfCCoDR supports this process by guiding discussions, improving communication, and helping parties find common ground. The outcome is entirely voluntary and based on mutual consent.
Mediation involves a neutral third party (mediator) who facilitates dialogue between disputing parties. The mediator assists in clarifying issues, identifying underlying interests, and guiding the parties toward a mutually beneficial resolution. The mediator does not impose a decision; the parties retain full control over the outcome. Mediation promotes cooperation and helps preserve relationships.
Arbitration is a more formal process in which a neutral third party (arbitrator) hears evidence and arguments from both sides. After the hearing, the arbitrator renders a binding and enforceable decision (known as an award). Arbitration is similar to court litigation but is typically faster, more flexible, and confidential.
